People hold contrasting opinions on how criminals should be punished for their offences. While some suggest that offenders of the same type of crime should be punished in the same way, others conceive that the punishment should be passed depending on the individuals’ circumstances and purpose. My belief resonates with the latter group.
People who believe that fixed punishment guarantees justice for the victims would support the former argument. This is because these punishments were designed with regards to solely the outcomes of the crimes. In other words, once damage has been endured by the society, a corresponding consequence must occur. In this sense, justice will be delivered equally, reducing the involvement of bias, favoritism, or social leverages. Moreover, a fixed punishment system would be easy for the court to administer, thus pushing the efficiency of the court services to meet demands of the society. Supporters also concur that once consequences take on a virtue of simplicity, and people become easily aware of how they will be punished, there is a likelihood that criminals would think twice before committing a crime.
However, detractors, like myself, would argue that fixed punishments might not uphold real justice. The State should bear in mind that it assumes the responsibility to protect its citizens, regardless of their actions. If the circumstance of a crime and the motive of the criminals were to be overlooked, there are chances of the offenders being exploited by an incomplete account. It is undoubtedly unfair to punish individuals who were forced to kill the victim for self-defense in the same way as a serial killer. Hence, the judge should evaluate all sides of the story to decide on the best response.
In conclusion, despite the advantages of fixed punishment, it seems more important that justice is upheld. One of the ways is to not dismiss the nature of the criminals before a sentence is passed.
